Who is required to carry workers compensation insurance in Arkansas?
Generally, most employers with three or more employees are required to have insurance coverage. State law requires workers compensation coverage for employers:
- with three or more employees who are regularly employed by the same employer;
- with two or more employees who are engaged in building or building repair work;
- with one or more employees who are employed by a contractor who subcontracts any part of their contract; or
- with one or more employees who are employed by a subcontractor.
Workers compensation insurance is not required for employers of agricultural farm labor, domestic help, or non-profit, religious, charitable or relief organizations and personnel covered exclusively by federal law such as railroad and maritime workers.
