Compensable injuries
Generally, injuries arising out of and in the course of employment, regardless of whose fault it is, have potential for workers compensation benefits. This includes occupational diseases and cumulative trauma injuries.
Occupational diseases and cumulative trauma injuries are conditions that develop over time in the workplace.
Unless the employer can provide substantial evidence to the contrary, Hawaii law includes a presumption in favor of the worker for covered injuries or diseases.
