Compensable injuries
Generally, injuries arising out of and in the course of employment, regardless of whose fault it is, have potential for workers compensation benefits. This includes occupational diseases and cumulative trauma injuries.
Occupational diseases and cumulative trauma injuries are conditions that develop over time in the workplace.
To qualify for benefits due to disease, the employee must either meet the statutory criteria for a listed disease or establish, through medical evidence, that the condition was caused by their employment.
- Occupational disease claims must result in disability within 300 weeks of the last exposure to the harmful condition.
